What is divorce Mediation?

Mediation is a cooperative process where a neutral mediator seeks to assist parties in reaching an agreement in order to resolve a dispute that may arise during a divorce.  Experienced mediators use their skills to help the parties understand and communicate the issues involved in their dispute so that they can negotiate a fair resolution.  However, the parties themselves determine the proper resolution rather than having a third-party, such as a judge or arbitrator, impose a resolution. 

Why Mediation?

During a divorce, it is in the best interest of both parties to try and resolve the terms of their divorce through mediation.  If an agreement can be reached during the mediation process, both parties may save thousands of dollars in legal fees, resolve their disputes in a far shorter period of time than if the matter was determined by the courts (sometimes as much as 18 months or even longer), and avoid the trauma and emotional stress associated with contested divorce litigation. Of course, if mediation is unsuccessful, the parties can elect to proceed with arbitration or collaborative divorce.

Studies have shown that parties who are able to resolve their divorce and custody issues by reaching an agreement-rather than having obligations imposed upon them by a judge-are more likely to comply with their child support and alimony obligations and adhere to the child custody and visitation arrangements they have reached.
