Divorce is the dissolution or ending of a marriage. Each year, many spouses decide to divorce or legally separate in the state of New York. Before spouses can go through the divorce process, they must meet the state’s residency requirements and have legitimate grounds for divorce. If spouses do not meet these legal requirements, they may not be allowed to obtain a divorce.
Residency Requirements
In New York, spouses may be eligible to obtain a divorce if:
- Both spouses were married in New York, and one of the spouses is a New York resident when the divorce process commences, and has been a resident of New York for at least a year before the commencement of the action.
- Both spouses have resided in New York as husband and wife, and one of the spouses is a resident of New York for one year before the divorce process commences.
- The grounds for divorce took place in the state of New York, and one spouse has been a New York resident for at least one year before the divorce process commences.
- The grounds for divorce took place in the state of New York, and both spouses have been residents of New York before the divorce process commences.
- One spouse, or the other, has been a resident of New York for at least two years before the divorce process commences.
Grounds for Divorce
New York has six legal grounds for divorce. Four of the grounds are based upon the “fault” of either spouse, and two are considered “no fault”. Abandonment for a year or more, cruel and inhuman treatment, imprisonment for more then three years, and adultery are all considered “fault” grounds. The two “no fault” grounds for divorce are one year of living apart in accordance with a Court issued separation agreement and living under a separation agreement that has been signed by both spouses.
